Terms

1. Provider and scope

ai-toolfinder.com is a directory of AI tools for HR. It is operated by Nick's Advisory, Nick's sole proprietorship in Frankfurt am Main, Germany. Full details are in the legal notice.

These terms apply to the use of the website, to accounts and to all content you submit. The review guidelines are part of these terms. The page How we review explains how we select tools, check reviews and sort results.

2. Service

The directory is free. You can read, search and compare without an account. You need an account to write a review, submit a tool or take over a profile as a vendor.

We aim to keep the website available, but there is no right to constant availability. We may change, add or discontinue functions. If we shut down the directory entirely, we will inform account holders by email beforehand.

3. Account

  • Anyone aged 18 or over may create an account. If you act for a company, for example as a vendor, you must be authorised to do so.
  • Use an email address that you control. Each person may have only one account.
  • You sign in with a link that we send to your email address. Protect access to your mailbox and do not pass on sign-in links.
  • You can delete your account at any time under Account. This ends the user agreement.
  • We may terminate the user agreement by email with two weeks' notice. The right to terminate for good cause remains unaffected, for example in case of serious or repeated breaches of these terms.
  • Before we suspend or terminate an account, we inform you and give you the opportunity to comment. We only skip this if the breach is so serious that this cannot reasonably be expected of us.

4. Rules for your content

Content means everything you send us: reviews, tool submissions, requests to take over a profile, vendor replies and reports. For all content:

  • Statements of fact are true. Experiences and opinions are your own.
  • It does not break the law and does not infringe the rights of others, such as copyright, trademark or personality rights.
  • It contains no personal data of other people, no advertising and no links. Links to the tool's website in a submission are the exception.
  • You disclose your relationship to the tool and to the vendor.

Uploads must meet the technical requirements (file format, size) stated in the relevant form.

The following is also not allowed:

  • creating several accounts or submitting content automatically,
  • getting around technical blocks or checks,
  • automatically extracting or copying substantial parts of the directory, for example for your own directory. Indexing by search engines remains allowed.

Reviews are also subject to the review guidelines. We add tools according to the criteria on the How we review page. There is no right to have a tool listed.

5. Rights to your content

You keep the rights to your content. You grant us a non-exclusive, free and worldwide right to use your reviews, replies, submissions and the logos and texts you provide as a vendor for ai-toolfinder.com. This covers storing, copying, publishing and making them available to the public, also in excerpts, in comparisons, in preview images and in structured data for search engines. We may use the technical service providers listed in the privacy policy for this.

  • Reviews and replies: the right applies as long as the content is published. We do not change the content. If it does not meet the rules, we reject or remove it.
  • Tool submissions: we may edit, shorten and translate your details and combine them with our own research into a profile. This right is not limited in time, because the details become part of the profile.
  • Vendor logos and texts: we may use them to identify and describe the tool until the vendor asks us to remove them.

You confirm that you hold the necessary rights to your content. If third parties bring claims against us because of content that you culpably posted in breach of the law, you indemnify us against these claims, including reasonable legal defence costs.

6. Moderation

A person checks every review, submission, vendor reply and request to take over a profile before it is published or approved. Nick does this personally. The standard is the law, these terms, the review guidelines and the inclusion criteria.

Automatic checks help with this:

  • The form rejects a review if the domain of the email address belongs to the domain of the reviewed tool, or if the same account has already reviewed the same tool.
  • The system flags reviews for a closer look if the email domain belongs to a competitor in the same niche, or if a tool receives unusually many reviews in a short time.
  • The system compares the email domain with a list of free email providers to assign the verification level "Work email verified".

In all other cases a person decides on publication. If a review is rejected automatically, Nick will look at it personally when you contact us.

Possible measures are: not publishing content, removing published content, withdrawing a verification level or vendor status, suspending or terminating an account. We act diligently, objectively and proportionately and take into account the rights of everyone involved, in particular freedom of expression. We publish reviews that meet the rules, positive and negative alike. We check whether a review meets the rules. We do not check whether every single statement in it is correct. Reviews reflect the opinions of their authors, not ours.

7. Statement of reasons and objection

If we reject or remove content, withdraw a verification level or vendor status, or suspend an account, you receive a statement of reasons by email (Article 17 DSA). It states:

  • the measure and, where relevant, its scope and duration,
  • the facts we rely on, and whether the decision is based on a report or on our own review,
  • whether automatic checks were involved,
  • the rule in these terms or the law that the content breaches, with an explanation,
  • your options to challenge the decision.

You can object by email to nick@nicksadvisory.com within six months. Nick reviews the objection personally, without automated tools, and tells you the result with reasons. If the decision was wrong, we reverse it.

Nick's Advisory is a micro enterprise. The obligations to run an internal complaint-handling system (Article 20 DSA) and to engage in out-of-court dispute settlement (Article 21 DSA) therefore do not apply (Article 19 DSA). We offer the objection voluntarily. You can go to court at any time.

8. Reporting illegal content

Anyone can report content they consider illegal, also without an account: via "Report" on every review and profile, via the Report content page or by email. A report should contain (Article 16 DSA):

  • an explanation of why the content is illegal,
  • the exact address (URL) of the content,
  • your name and email address,
  • a statement that you believe in good faith that your information is accurate and complete.

We confirm receipt, handle the report promptly and carefully and tell you our decision, together with your options to challenge it. The person whose content is affected receives a statement of reasons under section 7. If a report concerns a review, we usually ask the reviewer for a statement and, where appropriate, for proof of use. We do not pass the reviewer's identity to the vendor unless we are legally obliged to.

If content indicates a criminal offence that threatens the life or safety of people, we inform the competent authorities (Article 18 DSA).

9. Rules for vendors

  • A vendor takes over a profile by signing in with an email address at the tool's domain and being confirmed by us.
  • Confirmed vendors may suggest corrections of facts, provide a logo, reply to reviews and add the "Listed on ai-toolfinder.com" badge. We check corrections and replies before publication.
  • Replies to reviews are factual and contain no data about the reviewer, no attempts to identify them and no advertising.
  • Vendors may ask customers for reviews if they approach all customers or a random selection and do not select by the expected rating. Such reviews carry the note "Invited by vendor". Any incentive must not depend on the content or the star rating and must be disclosed.
  • Not allowed: having lawful reviews removed, buying a placement, superlatives without evidence ("market leader", "number 1"), reviews by your own staff or by third parties acting for you, pressure on reviewers.
  • The badge is used unchanged and links to the tool's profile. Vendors may also host the image file on their own server. We may change the badge or withdraw permission in case of misuse.

In case of breaches, we may remove replies and affected reviews and withdraw the vendor status.

10. Directory content, no legal advice

Tool profiles are based on vendor information and public sources as of the "Profile checked on" date. Features, prices and conditions change. Check important details with the vendor before you decide. Reviews are the opinions of their authors.

Notes on works councils, data protection, the EU AI Act and other legal topics are general information and not legal advice. For your specific case, contact a lawyer, your company's data protection officer or the works council.

Vendors do not pay for inclusion, texts or ranking. Should there ever be paid placements, they will be visibly labelled "Ad".

11. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and where we have given a guarantee. For slight negligence, we are only liable if we breach an essential contractual obligation, meaning an obligation whose fulfilment makes the use of the directory possible in the first place and on which you may regularly rely. In that case liability is limited to the foreseeable damage typical for this kind of agreement. Otherwise liability is excluded.

12. Changes to these terms

We inform account holders by email about significant changes at least two weeks before they take effect. For existing accounts, changes only apply once you agree, for example at your next sign-in. If you do not agree, we may terminate the user agreement with two weeks' notice. You can delete your account at any time.

13. Applicable law and place of jurisdiction

German law applies. If you are a consumer, you keep the protection of the mandatory provisions of the country where you have your habitual residence. If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Frankfurt am Main, Germany.
