What HR teams in Germany should know
- Employee data: the GDPR applies directly, Section 26 BDSG only in part. Since the CJEU ruling C-34/21 of March 30, 2023, and a Federal Labor Court ruling of May 8, 2025 (8 AZR 209/21), Section 26(1) sentence 1 BDSG no longer counts as a separate legal basis. Employers process employee data directly under Article 6 GDPR, for example to perform the employment contract, or under a works agreement based on Article 88 GDPR. - Works council consent for AI monitoring tools. Section 87(1) No. 6 of the Works Constitution Act (BetrVG) gives the works council a binding right of co-determination before any technical system able to monitor employee behavior or performance goes live. - EU AI Act high-risk employment duties postponed to December 2027. The EU AI Act lists AI for recruitment, promotion, termination, task allocation and performance monitoring as high risk (Annex III No. 4). The Digital Omnibus Regulation (EU) 2026/1744, in force since July 27, 2026, moved the compliance deadline for these duties from August 2, 2026, to December 2, 2027.
