Employer of record AI features compared: what Deel, Remote, Oyster and Papaya Global automate

An employer of record (EOR) becomes the legal employer of your staff in a country where you have no entity and runs their contract, payroll, taxes and benefits, while you direct the work. As of September 2026, Deel lists EOR at $599 per employee per month, Remote at $599 paid annually or $699 paid monthly, and Oyster at $699, and their AI features answer country law questions, check payroll or flag contractor risk. None of that AI moves permanent establishment or misclassification risk off your company: an EOR reduces the tax risk, but what your people actually do in the country still counts.

What an employer of record does, and what stays with you

An employer of record is the legal employer on the employment contract. Deel describes it as a third party that employs workers on your behalf, is named on the contract and assumes the liability. Oyster lists compliance, payroll, taxes, benefits, onboarding and terminations as the EOR's work, while the client manages the team day to day.

The alternative is your own entity, which Oyster estimates takes 4 to 6 months to open and 4 to 6 weeks to hire into, against onboarding in as little as 48 hours through its EOR. In the United States, Deel and Remote also sell a professional employer organization (PEO) service, which the IRS describes as handling payroll administration and tax reporting for business clients, listed at $125 and from $99 per employee per month.

Intellectual property needs the same care, because on paper the EOR is the employer. Deel says its contracts pass all IP created by the employee through to the customer, and Remote offers an IP Guard feature with its contractor of record plan to move IP to the client. Check the clause in your own contract rather than the marketing page.

Of the 4 EOR specialists in our directory, 3 publish a list price. As of September 2026, Deel lists $599 per EOR employee per month, Remote $599 per month paid annually or $699 paid monthly, and Oyster $699 with annual discounts available. Papaya Global's AWS Marketplace listing prices EOR per employee per month through private offers, with no public rate.

The list price is not the whole bill. Oyster asks for a refundable deposit for EOR team members and charges a conversion fee when you pay in a currency other than the contract currency. Remote charges no platform, onboarding or setup fees for EOR, but its global payroll product carries an implementation fee and a recurring delivery fee. Contractor products cost far less, which is one reason the classification question matters. Deel lists contractor management at $49 per contractor per month and Remote and Oyster at $29 (Oyster after 30 free days), and Deel and Remote both sell a contractor of record service, where the provider engages the contractor itself, from $325. Indemnities differ as much as prices. Remote advertises uncapped indemnity on its contractor of record plan and indemnity of up to $100,000 per contractor on its $99 Contractor Management Plus tier. The contract clause, with its cap, exclusions and conditions, decides what such a promise is worth.

Country coverage: owned entities vs in-country partners

Coverage figures look comparable and are not. Deel says it owns entities and its payroll engine in 130+ countries. Remote offers EOR in 90+ countries, says it owns and operates 100 percent of its entities and reported 100+ owned legal entities worldwide in May 2026.

Oyster offers EOR in 120+ countries and says it employs more than 80 percent of hires through its own entities, working with vetted local experts in a few regions; the 180+ countries on its homepage cover hiring, pay and care across all services, contractors included. Papaya Global's AWS Marketplace listing describes EOR in over 160 countries through a network of in-country partners, and in September 2026 the company told analysts it has native gross-to-net payroll and EOR coverage in 110 of 180 countries, a figure The Next Web reported as company data.

Even a single vendor's figures move between pages: in September 2026, Deel's site cited 100+, 110+, 130+ and 150+ countries in different places. Ask for the entity type in each country you plan to hire in, and who signs the employment contract there.

A partner model is not wrong in itself, but it adds a company to the chain. Oyster says its legal and compliance teams run ongoing due diligence on partners and that customers always deal with Oyster, never with the partner. Ask to see that due diligence for your countries, and find out whether the partner or the EOR holds the payroll data.

Employer of record AI features: what they automate and who decides

The AI on sale falls into 4 groups: assistants for country law questions, payroll checks, contract generation and review, and worker classification. Most of the features below launched between April 2025 and June 2026, and the vendors present them as support for people, not as a replacement for counsel.

Oyster AI, launched in April 2025, answers questions such as sick leave rules in the Philippines from country guides reviewed by Oyster's HR and legal experts, and cannot see account or team member data. Papaya Global launched ONE in June 2026, a compliance tool that reviews contracts and policies against current statute in 95 countries and all 50 US states, free for any organization. G-P, whose EOR is listed on ADP's marketplace, offers Gia, a generative assistant that reviews documents and drafts HR resources across 50+ countries.

Deel launched an AI Workforce of agents in March 2026, including Payroll AI, which catches anomalies before a pay cycle starts and traces changes to their source, and a Hiring Agent that can run inside ChatGPT. Remote added AI summaries of time-off and expense requests to its mobile app in February 2026, and in May 2026 launched Remote MCP, a connection that gives AI agents access to its payroll, contract and compliance data.

Classification is where a wrong answer costs most. Deel says its Worker Classifier reaches over 90 percent accuracy, is localized for 15 countries and builds on research from Queen's University, and Remote includes AI tools against misclassification in its contractor of record plan. Papaya Global attaches a mandatory disclaimer to every ONE output saying the findings are not legal advice, and Oyster says its assistant does not replace expert guidance on complex topics.

Misclassification and permanent establishment: the risks AI does not remove

Whether a contractor is really an employee is decided by national tests, not by a vendor's score. The IRS weighs behavioral control, financial control and the type of relationship, and an official ruling through Form SS-8 can take at least 6 months. In the United Kingdom, medium and large private sector clients have decided a contractor's status themselves since April 6, 2021, under the off-payroll working rules known as IR35.

The EU is tightening the test for platform work: Directive 2024/2831 presumes an employment relationship where facts indicate direction and control, and member states must transpose it by December 2, 2026. A classifier localized for 15 countries, as Deel describes its tool, leaves most EOR countries without a local model, so treat its score as a first screen and send risky cases to counsel.

Permanent establishment is the risk that your own company, not the EOR, is treated as having a taxable business presence in the country. Deel says an EOR significantly reduces this risk and lists revenue-generating activity by employees and control of their work by the parent company among the triggers that remain. In the United Kingdom, for periods beginning on or after January 1, 2026, a person who habitually concludes contracts, or habitually plays the principal role leading to contracts the company signs without material changes, can create a permanent establishment.

Some countries limit the model itself. Mexico's April 2021 labor reform prohibits subcontracting of personnel and allows only specialized services outside the client's core business, delivered by registered providers. In Germany, lending employees to a third party counts as temporary agency work, which needs a license and is capped at 18 consecutive months with the same client.

What to check before signing an EOR contract

Start from the countries you will actually hire in, not from the headline coverage count. The same provider can employ through its own entity in one country and a partner in the next, and the AI features cover fewer markets than the EOR itself: Papaya Global's ONE covers 95 countries, G-P's Gia 50+ and Deel's classifier 15.

Check how the EOR connects to your HR suite. In March 2025, Personio announced an EOR embedded in its suite and powered by Remote, which Remote called a first for a major HR system in Europe, the Middle East and Africa to do so through a partner, and Remote's EOR became a Workday Certified Integration in August 2026. ADP's marketplace lists G-P's EOR, and HiBob listed 9 EOR partners in its marketplace in October 2022, Deel and Oyster among them.

Compare the security evidence as well. Deel, for example, lists SOC 1, SOC 2 and SOC 3 reports and ISO 27001 certification, with primary operations in Ireland and a disaster recovery site in France.

Treat AI connectors like any other integration. Remote MCP gives AI agents access to payroll, contract and compliance data, so decide which agents may use it and keep a log of what they read; Oyster AI, by contrast, cannot see account or team member data at all.
