Personal data may leave the Kingdom to a country with adequate protection, or to others under safeguards such as standard contractual clauses or binding corporate rules. Transfers must not exceed the minimum data needed. Banking transfers need Saudi Central Bank approval, and telecom and IT providers face extra restrictions. What HR teams in Saudi Arabia should know
- PDPL fully enforceable since September 2024. Saudi Arabia's Personal Data Protection Law (PDPL), overseen by the Saudi Data and AI Authority (SDAIA), became fully enforceable on September 14, 2024. It applies to any organization processing personal data of people in the Kingdom, including HR data, regardless of where the processing happens. PDPL, IAPP · as of September 2026
- Saudization quotas require digital contracts on the Qiwa platform. The Nitaqat program requires private employers with more than 9 staff to hire a quota of Saudi nationals, tracked by the Ministry of Human Resources. Since April 15, 2026, only Saudi employee contracts documented on the government's Qiwa platform count toward that quota, which makes Qiwa integration relevant for any HR or recruiting tool used in the Kingdom. Nitaqat program, Mercans · as of September 2026
- Official standard clauses for transferring HR data abroad. In September 2024 the Saudi Data and AI Authority (SDAIA) published standard contractual clauses under Article 29 of the PDPL and the Regulation on the Transfer of Personal Data Outside the Kingdom. They are one of three safeguards, alongside binding common rules and accreditation certificates, for sending personal data to countries without an adequate protection level. The approved wording may not be modified, and the foreign recipient must accept Saudi jurisdiction and cooperate with SDAIA audits.
