What HR teams in Australia should know

  • Employee records are largely exempt from the Privacy Act. Australia's Privacy Act 1988 exempts an employer's handling of current employees' personal information directly related to the employment relationship from most privacy obligations. The government has agreed in principle to narrow or remove this exemption, but as of mid-2026 no bill has passed and no start date is set. Privacy Act 1988, Pinsent Masons ยท as of September 2026
  • Australia dropped mandatory AI guardrails for a voluntary approach. Australia proposed 10 mandatory guardrails for high-risk AI in 2024 but shelved them in its National AI Plan of December 2025, relying instead on existing privacy, consumer and anti-discrimination law plus voluntary guidance. From December 10, 2026, businesses must disclose the kinds of decisions made through automated means and the personal information used. National AI Plan, Harrison Human Resources ยท as of September 2026
  • Fair Work Act requires consultation on major workplace change. Australia has no works council system. Every enterprise agreement under the Fair Work Act 2009 must include a consultation clause obliging the employer to consult employees, through their representatives, before major workplace changes, which can include introducing a new AI system that significantly affects staff. Fair Work Act 2009, Section 205, AustLII ยท as of September 2026
