Since January 1, 2026, Ontario employers with 25 or more employees must state on public job postings if AI is used to screen, assess or select applicants, under the Working for Workers Four Act, 2024. The rule does not require explaining how the tool works, only that it is used. Working for Workers Four Act 2024, Hicks Morley ยท as of September 2026
- Quebec requires disclosure of automated HR decisions. Quebec's Law 25 has required, since September 22, 2023, that anyone using an automated system to make a decision about an employee or applicant, such as AI screening, tell that person, explain the decision on request, and allow a request for human review. There is no equivalent federal rule for the rest of Canada. Loi 25, aiGovernance.ca ยท as of September 2026
