What businesses in China should know
- China offers three routes for sending personal data abroad, certification is new in 2026. Under PIPL, personal information leaves China through a CAC security assessment, filed standard contract clauses or certification. The certification measures of the CAC and SAMR took effect on 1 January 2026 and cover non-CIIO transfers of 100,000 to under 1 million individuals' data a year, or sensitive data of fewer than 10,000 individuals. Certificates last three years and require the individuals' consent to the transfer. Arnold & Porter, China personal information protection certification · as of October 2026
- China regulates AI through separate measures, a comprehensive AI law is still a plan. There is no single AI law. The Interim Measures for Generative AI Services apply since 15 August 2023, and the labelling measures for AI-generated content since 1 September 2025. The CAC, MIIT and TC260 share oversight, and the State Council's 2026 legislative work plan says comprehensive AI legislation should be accelerated. DLA Piper, AI Laws of the World: China · as of October 2026
What HR teams in China should know
- PIPL gives employees a right to refuse automated decisions. Article 24 of China's Personal Information Protection Law (PIPL, effective November 1, 2021) requires automated decision-making to be transparent and fair. When an automated decision significantly affects someone's rights, that person can demand an explanation and refuse a decision made solely by automated means. PIPL Art. 24, Cyberspace Administration of China (cac.gov.cn) · as of September 2026
- Platforms must negotiate algorithm rules with unions. Guidance issued in 2021 by eight government bodies, led by the Ministry of Human Resources and Social Security, requires digital platforms to consult unions or worker representatives before setting or changing algorithm rules that directly affect pay, task allocation, working hours or rewards and penalties, and to publish the results to workers. MOHRSS guidance 2021, gov.cn · as of September 2026
- Exemption for cross-border transfer of employee data. Under Article 5 of the Provisions on Promoting and Regulating Cross-Border Data Flows (CAC Order No. 16, 2024), employers do not need a security assessment, a standard contract or a certification to send employee personal information abroad when this is genuinely necessary for cross-border HR management. The transfer must be based on lawfully adopted internal labor rules or a lawfully concluded collective agreement. Cyberspace Administration of China, 促进和规范数据跨境流动规定 (2024) · as of September 2026
